MyGlobalLounge terms
MyGlobalLounge allows members to create an individual lounge page,
to contact and communicate with other members around the world.
If you want to become a member and communicate with other members, you
have to read these rules and explain your consent during the process of
registration. The private use of MyGlobalLounge is free.
§ 1 Field of application
These terms and conditions are binding to all users, i.e. registered members and visitors of MyGlobalLounge.
§ 2 Obligation of registration
(1) It requires registration to take actively part in MyGlobalLounge
(e.g. create an own lounge, write posts and topics in the forum).
When registering you warrant that all information provided by you is
true and correct and you are at least 18 years old. If we feel that you
are under 18 years of age, we can delete your profile without notice
and terminate your membership.
Non-registered persons have read-only rights.
(2) During the process of registration the following information must
be given:
1. a nick (user) name that doesn't have to be the real name of the user
2. a valid e-mail address
3. a password consisting of at least five characters
4. real name
5. sex
6. and the date of birth
(3) In addition, the following information can be published:
1. city, street, postcode and country of origin
2. profession
3. hobbies
4. further interests
5. membership in other communities (e.g. MySpace)
(4) The information in §2.2 has to be updated regularly.
(5) Precondition for registration is the acceptance of these terms.
(6) The acceptance of a user is the sole responsibility of the
operators.
(7) There is no legal claim for registration.
(8) Registered users can be excluded at any time by the operators
without giving reasons.
(9) The right to extraordinary exclusion according to § 626 BGB (German law) remains unaffected.
(10) Registered users can terminate their membership without notice at any time without giving reasons.
(11) To maintain an active community, we want to avoid „invisible“ loungers. Members who have not
1. activated their lounge
2. set a marker
3. set up a lounge
4. uploaded a photo or avatar
within one week after their registration will receive an e-mail with the request to upload a photo or an avatar. If they don't comply with this request after another two weeks, their registration will be cancelled and their data erased.
§ 3 Rights of members
(1) Every registered user has the option to create an individual
lounge page, write contributions and topics in the forum or to respond
to contributions.
(2) Users can communicate via shoutbox and/or e-mail if the respective users have
published valid e-mail addresses.
(3) There is no claim for deletion of posts and topics.
(4) Newsletters with the latest information about MyGlobalLounge might
be sent to members. Users can cancel the reception of the newsletter at
any time.
§ 4 Rights of the operators
(1) The operators have the right to move, clear and close in whole
or in part member profiles, posts and topics without giving reasons.
(2) If posts or topics violate these terms or applicable law, partial change or complete
deletion of posts, topics and user profiles is permitted immediately.
§ 5 Code of conduct
(1) The creation of posts and topics in the forum, your lounge page
as well
as any other comments in MyGlobalLounge are prohibited if they are
indecent, inhuman or unlawful. In particular posts, topics, photos and
avatars are banned if they are:
a) offending
b) defaming
c) molesting
d) menacing
e) libelous
f) hateful
g) obscene
h) indecent
i) pornographic
j) liable to corrupt the youth
k) racist
l) inhuman
(2) If the terms or board rules are violated, the operators may ban
the user without prior warning. In addition, the operators reserve the
right to claim for indemnification and to take legal action.
(3) In addition to internal sanctions in form of a ban unlawful
violations of these rules will be reported to the respective
authorities.
(4) Even outside the MyGlobalLounge internet pages users have to
refrain from acts that are liable to jeopardize the reputation of
MyGlobalLounge. Violations may result in the ban of the user.
(5) The operators can delete any content violating these terms.
§ 6 Commercial use
Any commercial use of MyGlobalLounge requires approval by the operators. In particular contributions with unauthorized advertising may result in the immediate ban of a member.
§ 7 Disclaimer
(1) The operators of MyGlobalLounge are not liable for law
violations and other misconduct of users or members.
(2) For the content and accuracy of posts and other contributions no
guarantee or liability is assumed.
(3) For violations of copyright law only the causer is liable. The
operators are in no way liable.
§ 8 Privacy policy
(1) The personal data of users are kept confidential by the
operators.
(2) The personal data is solely for the purpose of identity
verification.
(3) With the registration the user accepts the storage of his / her
personal data for the designated purpose in §8.2.
(4) The agreement may be recalled at any time without giving reasons via
e-mail.
(5) If you register as a member, you will be asked to choose a
password. The secrecy of your password to third parties is solely in
your responsibility.
§ 9 Enforcement
(1) The enforcement of these terms rests with the operators, who
might be supported by moderators.
(2) To enforce these terms the operators and their moderators have the
option to admonish users who violate the terms. In addition, a temporary
or permanent exclusion from MyGlobalLounge might be imposed.
(3) If users get to know violations of these terms of other users, the
operators (moderators) have to be informed immediately by them.
If the terms of use are modified the registered users are informed by e-mail two weeks before its coming into effect. If a user disagrees with the modifications, he’s free to terminate his membership in accordance with § 2.10.
